Will my personal injury lawsuit go to court?

While it is possible that your personal injury lawsuit may need to go court, the vast majority of these lawsuits are privately settled out of court. When they are settled outside of the courtroom, the defendant and plaintiff will sit down with their respective legal representatives and work out a settlement that is amicable to both parties. However, every case is different and some may require litigation in an effort to recover the damages the plaintiff believes he or she has sustained.

With that in mind, the San Diego personal injury lawyers at Ritter & Associates are prepared to help you pursue whatever course of action is most suitable to your interests. To discuss the particulars of your situation with one of our personal injury lawyers, please call our San Diego offices at (619) 296-0123 today.

Police investigate three fatal hit and run crashes in San Diego County

Three pedestrians were killed in three separate hit and run accidents in San Diego County, California – one in National City, one in City Heights, and finally north of Oceanside – on the Sunday night of December 28, NBC San Diego reported.

According to a police report, a white, older model pickup truck struck a pedestrian walking across the crosswalk on Plaza Boulevard near Highland Avenue in National City at around 6:30 p.m.

Police described the truck as a Nissan or a Toyota that probably incurred front-end damage on the passenger side. The pedestrian victim was 75-year-old Armando Guerrero.

At around the same time, a 23-year-old man perished after being hit by a dark-colored Lincoln Navigator in City Heights.

Near Camp Pendleton, a 24-year-old man attempted to run across the street, and he was hit by multiple vehicles. The first to make contact was a mid-size pickup truck that quickly fled the scene.

Police are conducting ongoing investigations into these instances in hopes of recovering the perpetrators.

Burn risk prompts Keurig recall of 7.2M coffee makers

Just days before Christmas, Keurig Green Mountain, Inc., a leader in the coffee maker industry, recalled over 7 million MINI Plus Brewing Systems in the United States and Canada after roughly 200 reports were made that this single-serve coffee machine may cause burns, according to a USA Today article.

Customers cited instances of hot water leaking from the machine, resulting in varying burn injuries. According to the Keurig website, the recalled products were produced and sold to customers from December 2009 to July 2014.

Immediately following the recall, Keurig stock fell 2.5% in morning trading. Mark Ashtrachan, a Stifel analyst, believes this recall could hurt the image of the company, as well as affect future sales.

Manufacturers have the responsibility to construct products that are entirely safe for public use; therefore, when defective products are released onto the market, companies may be held fully accountable for any injuries that result. Head-on collision in Oceanside seriously injured two

The car collision happened along the 1300 block of Sleeping Indian Road at around 7 p.m. According to preliminary investigations conducted by local fire officials, a Ford truck was headed north while a small passenger car was traversing the southbound lanes when they hit each other head-on. The truck ended up on top of the smaller car, pinning a man and woman inside the vehicle.

Man leads San Diego police on high-speed chase

What started as failure to yield at a traffic stop in San Diego on Monday turned into a high-speed chase across four freeways before the man was finally apprehended, according to a CBS8 report. The driver, 26-year-old Casey Rios, sped over 90 mph across State Route 52, SR-125, SR-94, and I-805. The officers in pursuit managed to catch him after putting a tire-puncturing spike strip in his path, forcing Rios to pull over just north of Balboa Avenue.

The pursuit began a little after 11 a.m. and lasted about 20 minutes before Rios was arrested. When Rios was in custody, the police searched his car, as Rios admitted to having Xanax and marijuana in his vehicle.

Reckless driving is a serious offense in San Diego and can lead to very serious auto accidents. While Rios is fortunate he did not involve any other vehicles in a car accident due to his reckless driving at high-speeds, other offenders of reckless driving have not been so lucky. If you have sustained a personal injury due to an accident caused by reckless driving, the renowned San Diego personal injury lawyers with Ritter & Associates may help you pursue legal action. Widely prescribed antibiotic Levaquin possibly dangerous

Levaquin, an antibiotic widely used to treat pneumonia, chlamydia, gonorrhea, and other conditions, and one of the most commonly prescribed antibiotics on the market, is said to cause painful and long-term side effects, ABC15 Investigators reported on November 24.

Jenny Frank, a patient from San Diego who was prescribed the drug, said after three weeks of taking Levaquin, she started regularly typing “gibberish” on her computer and was entirely unable to construct sentences.

Dr. Charles Bennett, a member of the South Carolina College of Pharmacy and the Southern Network on Adverse Reactions, has been filing petitions with the Food and Drug Administration to halt the production of Levaquin and other fluoroquinolones, because after three years of studying the effects of these drugs on humans, he found that they could alter and damage the body’s cells.

If you have suffered from a product that is inherently dangerous, the manufacturers may be held responsible with the help of a product liability attorney. Call the legal team of Ritter & Associates, at (619) 296-0123 today to learn more.

What does the term “statute of limitation” refer to?

While anyone who is injured through another person’s negligence or recklessness may be entitled to recover damages related that individual’s accident, there is a limited period of time to do so. This period of time in which an individual must file a personal injury claim is known as the statute of limitations.

So, if a personal injury claim is not made within the statute of limitations, the injury victim will no longer be capable of seeking compensation for the damages associated with his or her injury. For personal injury within California, for instance, the statue of limitations is two years from the injury, or one year from the date the injury was discovered.

Fire victims sue Omni La Costa Resort in San Diego

Homeowners in Carlsbad, California filed a lawsuit on October 10 against Omni La Costa Resort and Spa, located in the San Diego area hills, for a fire that occurred on May 14 and burned 27 structures and more than 600 acres of land, the Seaside Courier reported.

The lawsuit alleges that the fire was the result of the resort staff’s negligence. The suit, which is seeking an unspecified amount for damages, claimed that Omni staff started the fire while using equipment, possibly a lawnmower or maintenance cart. Their negligence to prevent the fire from both occurring and spreading directly led to the destruction of nearby property and land. Most of the evidence is based off of small scraps of metal found near the fire’s starting point.

It is often the case that an individual or company’s negligent actions cause great destruction and personal harm. If you have experienced an accident of any kind due to someone else’s negligence, the San Diego attorneys at Ritter & Associates may help you hold them accountable.
