Fresno car accident puts pedestrian in critical condition

An unidentified pedestrian sustained critical injuries after being hit by a speeding car in central Fresno, The Fresno Bee reported on June 18.

According to Fresno Police Department’s Sergeant Mike Smith, the car did not stop after colliding with the pedestrian, who had been attempting to cross the street near the intersection of McKinley and Normal avenues at around 9:45 p.m. The vehicle was thought to be a white or silver sedan.

The police said they were not able to gather descriptions of the driver involved in the incident. They continued conducting an investigation of the surrounding areas. The vicinity was closed off until the investigation concluded. The police encouraged anyone who might have information about the accident to contact them by calling Crime Stoppers at 498-STOP.

GM compensation program to begin August 1

General Motors will be launching a compensation scheme for the families of the victims affected by the ignition switch failure defect that prompted GM’s recent internal investigation, The Dallas Morning News reported on June 5.

The specifics of the compensation program will be outlined in the coming weeks by expert Kenneth Feinberg, who GM hired in April. Claims will begin being heard on August 1.

GM recalled 2.6 million compact vehicles to repair the ignition switch defect that was responsible for at least 13 deaths in the U.S. Attorney Anton Valukas conducted a thorough internal review of GM in relation to this issue. CEO Mary Barra assured that the delayed recall was not an intentional cover-up, but instead a series of mistakes and neglect.

Worker crushed to death by airport construction material

A 29-year-old construction worker, whom police have yet to identify to the public, was crushed by falling rebar at a rental car center construction site located within walking distance of the San Diego International Airport on May 20, NBC San Diego reported.

The new structure is located at the intersection of Pacific Highway at West Washington Street. An investigation conducted by coroners at the San Diego County Medical Examiner’s Office showed that the construction worker was climbing the rebar, steel rods with ridges used to reinforce concrete, with the intention of pouring concrete forms. Witnesses said that at around 8:45 a.m., the man was shouting that the rebar was falling, and soon after he fell victim to the weight of the collapsing material. Although co-workers ran to detach him from his safety harness, the man died at the scene.

The construction is for a $223 million rental car center, a project of the Austin/Sundt Joint Venture.

Van lands on sedan, kills five

According to police authorities of San Bernardino County, a vehicular traffic accident in Hesperia, California on May 11 resulted in the death of five individuals, USA Today wrote on May 11.

According to San Bernardino County Sheriff’s Department spokeswoman Jodi Miller, a Honda sedan was crushed as it sat at a stop sign, killing all of the car’s occupants. The incident occurred around 7 a.m. in Hesperia, a Mojave Desert town east of Los Angeles.

Emergency medical respondents extricated the bodies of an adult male, a male teenager, a young boy, and two other bodies. The identifications of the deceased have not been released by authorities. The driver of the van sustained minor injuries due to the incident.

Lawsuit filed in FedEx truck, bus crash

A lawsuit has been filed in regards to the fatal collision that took place on April 29th on Interstate 5 between a FedEx bus and a school bus hired by Dorsey High School to carry students to visit Humboldt State University.

The lawsuit was filed against FedEx Corp. and FedEx Freight, Inc., claiming that the companies had been negligent in regards to training drivers, operating vehicles, and disciplining their drivers, and are therefore liable for the crash that killed five people, including Jennifer Bonilla, a high school student and the daughter of the plaintiff, Rosa Bonilla.

The suit notes that FedEx trucks have a history of catching on fire for a variety of reasons, and that the company has done nothing to remedy this problem. The lawsuit also names the estate of the bus driver, 32-year-old Elk Grove resident Timothy Paul Evans, and the bus company, Silverado Stages.

 


Fatal California collision kills 10 people

On Thursday, April 10 ten people were killed in an explosive freeway collision involving a FedEx truck, an automobile, and a tour bus.

According to police investigators, a southbound FedEx truck crossed over a patch of grass on the interstate and then immediately hit the side of a car before crashing into the tour bus, which erupted into flames.

The bus that exploded during the crash had been one of three buses commissioned by Humboldt State University to give a tour to students of the Arcata campus as part of the university’s two-day Preview Plus program.

Included among the list of fatalities are Humboldt alumni and chaperones Michael Myvett, 29, and his fiancée, Mattison Haywood, 27, Humboldt admissions counselor Arthur Arzola, 26 and both drivers on the bus.


Lawyers seek to have judge who oversaw Toyota sudden acceleration case for GM lawsuits

Dana Taschner, one of the lawyers who filed a class action lawsuit against Detroit, Michigan-based automaker General Motors Co., has stated they requested to have U.S. District Judge James Selna, the one who handled Toyota Motor Corp.’s acceleration cases, to also preside over GM’s case. The request was filed in conjunction with a consolidation petition with the Judicial Panel on Multidistrict Litigation in Washington, D.C.

The lawsuit was filed last Monday, March 31 in Santa Ana, California, and is asking for $250 for every American GM vehicle owner, which amounts to over $350 million, and is in addition to punitive damages sought as a result of GM’s failure to disclose information regarding its defective auto parts.

GM more than doubled its recall-related expenses to $750 million on March 31 due to power steering defects in 1.5 million other vehicles in the United States, aside from the other vehicles it has earlier recalled. The defect was traced to the faulty ignition switch, which can cause the engine to stall and prevent air bags from deploying. It has been connected to at least 13 deaths in auto accidents.

Public hearing held over regulating safety of self-driven vehicles

California’s Department of Motor Vehicles (DMV) held a meeting in Sacramento to conceive of ways to regulate safety standards for self-driving cars. Self-driven cars aren’t yet on the market, but they are expected to be in circulation sooner than later.

At the Sacramento DMV meeting, questions were raised over safety logistics, namely, whether a person needs to be behind the wheel of the car, how insurance rates will change because of the new technology, and if the cars will really protect people from car accidents.

Under a 2012 California law, the state must create a set of rules that will enable these autonomous vehicles to drive on public roads and highways by this year.

Georgia man found guilty of recklessness for 2012 jet ski accident

On Thursday, February 20 a Hall County jury found Jeffrey Hubbard guilty of serious injury by vessel, reckless operation of a vessel, unlawful operation of a personal watercraft, and a boat traffic violation.

The charges are related to an summer 2012 accident that resulted in the injury of one child and the death of 11-year-old Kile Glover. Glover was the stepson of singer-songwriter Usher.

Hubbard accidentally hit the two children with a jet ski as they were being pulled on an inner tube on Lake Lanier.

Permanente Medical Group, Inc., sued by car accident victims

Ali Moqadam filed a negligence lawsuit against the Permanente Medical Group, Inc., Kaiser Foundation Hospitals, Kaiser Foundation Health Plan, Inc., and Dr. Maryalice Ambrose, M.D. for allowing a seizure patient to drive. The driver, Alma Valencia, caused a car accident in June of 2010.

Dr. Ambrose recommended that the State of California Department of Motor Vehicles suspend Valencia’s license after treating her for a seizure disorder in 2005. In 2007, Dr. Ambrose rescinded her request, allowing Valencia to get her license back.

The plaintiffs claim that Valencia’s seizure disorder makes her a threat on the road. Additionally, the plaintiffs claim that the medical institutions are responsible for damages from the car accident since they could have prevented Valencia from driving.
